What is DSPT?

The DSPT is an online toolkit which you are required to complete if you have access to any NHS data systems (including NHS Mail).

As we increasingly work in a digital world the NHS intends to further open its systems to Adult Social Care providers. By having access to the NHS’s digital systems it will transform the way we deliver care but in order to do this, providers must be able to demonstrate that they have adequate Data Protection policies in place.

This is where the Toolkit comes in. 

Completing the DSPT shows that you have good data protection and security protections in place. It is an extremely useful tool because it covers all areas of GDPR compliance that you as a Care Provider are required to implement, such as having up to date policies and ICO registration, ensuring you are operating within the law. It is also a contractual requirement to work with CCG’s and Local Authorities. 

It is looked upon favourably by CQC (KLoE 2.8 Well Led).

The DSPT has been rewritten to make it simpler to understand and many of the questions are now more care specific.  Completing the DSPT is not a 5 minute job and requires some preparation beforehand so a program of support is available to help you successfully complete the Toolkit, both at a national level and locally.

Previously published at Approaching Standards or Entry Level? 

If you previously published at Approaching Standards (or Entry Level), you have to get to Standards Met in order to republish your DSPT. You cannot publish at Approaching Standards more than once. It is a temporary arrangement to help you to get to Standards Met.

By completing your DSPT, you will provide evidence that you meet all of the minimum legislative requirements of the DPA and UK-GDPR as well as some cyber security best practice. Standards Met is the level that all care providers should be aiming for as it demonstrates that they also meet the health and social care data security standards.

The deadline for publishing your 2021/22 DSPT is 30 June 2022, but we strongly advise you to start your review now to give you time to complete.

The national data opt-out gives everyone the ability to stop health and adult social care organisations from sharing their confidential patient information for reasons other than providing their individual care and treatment. It was introduced on 25 May 2018 in line with the National Data Guardian’s recommendations but it did not apply to social care. However, this is about to change. 

All CQC registered adult social care providers in England must be compliant with this policy by 31 July 2022.

The Information Commissioner’s Office is the regulator for personal data and data protection legislation in England. If you fail to comply with the national data opt-out this could be a breach of your obligations to process data fairly and transparently.
